Subject: Feedback on Pay Transparency – Ensuring Fairness for All Ages, Races, and Experience Levels

From "Proposed Pay Transparency Legislation Consultation"

Go to the project

I am writing to support the proposed Pay Transparency Legislation because it is a vital step toward making Bermuda’s job market fair for everyone, regardless of age, race, or gender. Too often, people are pushed aside for entry-level opportunities because of a 'lack of experience'—but you cannot get experience without a first chance. I believe this legislation should require employers to use objective criteria that value potential and a willingness to learn.

Crucially, this 'fair chance' should apply regardless of age. Whether someone is 18, 30, or 50, they should not be aged out of an opportunity just because they are starting a new career path later in life. Furthermore, as a Black woman, transparency is essential to ensure that pay and hiring decisions are based on the value of the role, not on identity. By requiring salary ranges to be posted upfront and protecting our right to discuss pay without fear of being penalised, the Government can ensure that no one is overlooked or underpaid due to hidden biases. We need this framework to ensure that career paths are determined by hard work and skill, not by unattainable requirements.

I agree that "hiring decisions [should be] based on the value of the role, not on identity." Ms Scott writes that in the context of being a Black woman. But this cuts both ways. It should apply equally to an 18 year old white boy trying to get a job in the predominantly Black civil service as it should to a 60 year old Black woman trying for a job at the Yacht Club. I have had several careers and at age 77 I still work two jobs: software developer and flight instructor. I started working in 1965 at ZBM with a Black boss. At every stage I have had to promote myself. So while eliminating discrimination of every kind is vital, that doesn't mean that people seeking jobs shouldn't have to persuade potential bosses that they are up to the task at hand.
